📜 Welcome to the MyAcousticPro Ecosystem

By accessing myacousticpro.com, using our diagnostic software, ordering from our PrestaShop E-Shop, or participating in our phpBB forum, you enter into a legally binding agreement governed by European Union and Czech Republic law. If you do not agree with any part of these terms, you must discontinue use of our platform immediately.

1. Acoustic Calculators & Mathematical Simulation Disclaimer

The acoustic tools provided on MyAcousticPro (including RT60 decay calculators, modal standing wave finders, SBIR ray-tracing, and 4D WebGL wavefront simulators) generate algorithmic recommendations based on the empirical formulas of architectural acoustics and user-supplied dimensions.

⚠️ Critical Engineering Notice:

Digital simulations represent highly accurate mathematical approximations of enclosed sound fields. However, physical real-world anomalies—such as wall flexibility, drywall cavity resonance, window vibration, and structural furniture—can alter actual frequency responses.
Unless you have commissioned our Bespoke Custom Studio Design service with physical or remote laser validation, software outputs are provided "as-is" for guidance and optimization purposes without structural warranty.
We are not liable for any acoustic treatment purchases made solely on unverified self-measurements.

2. Software Subscriptions & Billing (Master Studio PRO)

Free Starter Tier: We offer a free diagnostic suite allowing users to perform basic RT60 evaluations and evaluate up to 5 room surface materials. We reserve the right to modify, limit, or discontinue free tier features at our discretion without prior notice.

Master Studio PRO Subscription (€39.99/mo): Upgrading to the PRO tier unlocks advanced 4D WebGL wavefront simulations, AI speaker placement optimizers (38% rule), and unlimited material calculations.

Billing Cycle & Renewal Subscriptions are billed monthly in advance. Your tier will automatically renew unless canceled at least 24 hours before the billing cycle concludes.

Cancellation & Refunds You may cancel your subscription anytime via your dashboard. Access to PRO tools continues until the end of the paid period. Digital subscriptions are non-refundable once activated.

3. E-Shop Hardware Orders & Shipping

All hardware orders placed through our curated E-Shop (including calibrated UMIK-1 measurement microphones, bass traps, broadband absorbers, and custom wooden Skyline diffusers) are governed by standard EU consumer commerce regulations:

Pricing & Tax: All prices are listed in Euros (€) and include applicable statutory Value Added Tax (VAT) for EU residents unless explicitly stated as B2B net pricing.
Shipping & Delivery: Delivery times vary by destination. Custom-fabricated wooden QRD diffusers require an estimated 10–14 business days for manufacturing prior to dispatch.
14-Day Right of Withdrawal: EU consumers have the right to return undamaged, standard-stock hardware within 14 days of receipt. Please note: Custom-sized acoustic panels or bespoke wooden diffusers fabricated to specific client room dimensions are exempt from standard return policies under EU law.

👑 VIP Turnkey Engineering Terms

4. Bespoke Custom Studio Architecture (From €1,999)

Our Bespoke Studio Design service represents a direct engineering engagement with our master acoustic architects. By commissioning a custom architectural project, the following terms apply:

100% Acoustic Guarantee We guarantee that our turnkey room treatment designs will meet reference ITU-R BS.1116-3 studio standards, provided that our material prescriptions and placement coordinates are executed exactly as specified in our CAD blueprints.

Client Verification Duty The client is responsible for providing accurate structural measurements, load-bearing ceiling capacities, and electrical layout constraints prior to the commencement of 3D ray-tracing simulations.

5. Community Forum Conduct (phpBB)

Our discussion forum is a collaborative platform for audiophiles, sound engineers, and studio designers to share waterfall plots, debate DSP treatments, and troubleshoot room acoustics. To maintain a professional environment, users agree to strictly avoid:

✖ Unsolicited commercial spam or unauthorized product promotion.

✖ Harassment, hate speech, or personal attacks against members.

✖ Uploading copyrighted material without explicit authorization.

We reserve the right to edit, censor, or remove forum content and permanently ban user accounts that violate these community guidelines without prior warning.

6. Intellectual Property & Algorithmic Protection

All content, visual interfaces, 3D/4D WebGL rendering code, DSP convolution scripts, and mathematical calculation algorithms hosted on MyAcousticPro are the exclusive intellectual property of the founders (Ing. František Tuček and Bc. Pavel Tuček) and are protected by international copyright and trade secret laws.

You are granted a limited, personal, non-exclusive license to use our calculators and software suites for your own studio or listening room design. You are strictly prohibited from reverse-engineering, scraping, copying, or commercially reselling our algorithmic calculation outputs or UI layouts without formal written consent.

7. Limitation of Liability & Governing Law

To the maximum extent permitted by applicable European law, MyAcousticPro and its engineering team shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from:

Improper physical installation, wall mounting, or ceiling suspension of heavy acoustic panels and wooden diffusers purchased from our E-Shop.
Inability to achieve desired soundproofing decibel reduction due to underlying structural building limitations (e.g., flanking transmission through concrete floor slabs).
Temporary software downtime, server maintenance, or WebGL rendering incompatibility on legacy client hardware.

These Terms of Service are governed by and construed in accordance with the laws of the Czech Republic (European Union). Any legal disputes arising from these terms or the use of our platform shall be subject to the exclusive jurisdiction of the competent Czech courts.
